תקנון האתר

ברוכים הבאים לאתר בלוק 26, המופעל על ידי טוקיו סטיילינג בע"מ, ח.פ. 516260817, שבזי 59, נווה צדק, תל אביב 6514432. תקנון זה מסדיר את היחסים בין החברה לבין כל משתמש או רוכש באתר ומהווה הסכם משפטי מחייב. הגלישה באתר, ביצוע הזמנה או רכישה מהווים הסכמה מלאה לתנאי תקנון זה. האמור בתקנון בלשון זכר מטעמי נוחות בלבד, ומתייחס לכל המגדרים באופן שווה.

1. תנאי שימוש כלליים

השימוש באתר וביצוע רכישות באמצעותו מיועדים לבני 18 ומעלה, המחזיקים באמצעי תשלום תקף ובלבד שכתובת המשלוח נמצאת בתחומי מדינת ישראל. קטינים רשאים לעשות שימוש באתר אך ורק בהסכמת הוריהם או אפוטרופסם החוקי. ביצוע רכישה באתר מהווה הצהרה של המשתמש כי הוא עומד בתנאים אלו.

החברה שומרת לעצמה את הזכות לשנות את תקנון זה מעת לעת, לפי שיקול דעתה הבלעדי. המשך השימוש באתר לאחר פרסום שינויים מהווה הסכמה לנוסח המעודכן. בכל מקרה של סתירה בין הוראות התקנון לבין תכנים אחרים באתר — הוראות התקנון גוברות.

1. עצמאות החברה — הבהרה משפטית חשובה

טוקיו סטיילינג בע"מ היא חברה ישראלית עצמאית הרשומה לפי דיני מדינת ישראל, הפועלת כיבואן עצמאי הרוכש מוצרים מספקים ביפן ומפיץ אותם בישראל תחת המותג בלוק 26.

הבהרה: אין כל קשר משפטי, תאגידי, סוכנותי או בעלות בין טוקיו סטיילינג בע"מ לבין יצרני המותגים M'S Collection, SCOMMAG, BLESS, Petit Collection ו-Hawaiian Jewelry, חברות האם שלהם, חברות בנות או גופים קשורים בחו"ל. החברה אינה סוכן רשמי, נציג מורשה, או חברה בת של מותגים אלה. כל פנייה, דרישה, תלונה, בקשת שירות, טענה או תביעה מכל סוג שהוא בקשר למוצרים שנרכשו באמצעות האתר, תופנה לחברה בלבד. למשתמש לא תהיה כל טענה, דרישה או תביעה כלפי היצרנים, בעלי המותגים, חברות האם שלהם, חברות בנות שלהם או מי מטעמם, בקשר למוצרים שנרכשו באמצעות האתר.

1. הזמנות, יבוא מיפן וזמינות מלאי

עם השלמת הרכישה מתבצע החיוב אוטומטית ונשלח אישור הזמנה לכתובת המייל שנמסרה. אישור קבלת ההזמנה מעיד אך ורק על קליטת ההזמנה במערכות החברה, ואינו מהווה אישור סופי לביצוע העסקה או התחייבות לאספקת המוצר.

מוצרי בלוק 26 מיובאים מיפן ונמכרים בישראל על ידי טוקיו סטיילינג בע"מ. זמינות המוצרים כפופה למלאי הקיים. פריטים שאינם זמינים במלאי מיידי מיובאים במיוחד עבור הלקוח בהתאם להזמנתו, וזמן האספקה המשוער עבורם עשוי לנוע בין 4 ל-8 שבועות ממועד אישור ההזמנה. ביצוע התשלום מהווה הסכמה מפורשת של הלקוח לזמני המתנה אלו ולעובדה שהמוצרים מיובאים מיפן.

החברה שומרת לעצמה את הזכות לבטל הזמנה מכל סיבה שהיא — לרבות אי-זמינות מוצר, הפסקת ייצור, שגיאת מחיר, עיכוב מכס, או כל סיבה אחרת אשר אינה מאפשרת את אספקת המוצר בתנאים סבירים. במקרה של ביטול הזמנה על ידי החברה, יושב ללקוח מלוא הסכום ששולם בפועל בגין ההזמנה שבוטלה, והלקוח לא יהיה זכאי לכל פיצוי, נזק עקיף, אובדן רווח או סעד נוסף, למעט ככל שהדבר מתחייב על פי דין.

תמונות המוצרים המוצגות באתר הן להמחשה בלבד. ייתכנו הבדלים קלים בין התמונה למוצר שיסופק בפועל, לרבות בגוון ומאפיינים נוספים.

1. מחירים ותשלום

כל המחירים המוצגים באתר נקובים בשקלים חדשים וכוללים מע"מ כדין, אלא אם צוין אחרת במפורש.

החברה רשאית, לפי שיקול דעתה הבלעדי ובכל עת, לעדכן, לשנות או להסיר מחירים, מבצעים, הנחות, הטבות, מוצרים, קולקציות, מלאים ותנאי מכירה, כולם או חלקם, ללא הודעה מוקדמת. שינויים כאמור יחולו ממועד פרסומם באתר בלבד ולא יחולו על הזמנות שאושרו והושלמו קודם לכן.

המחיר המחייב הוא המחיר שהוצג באתר במועד השלמת ההזמנה ואישורה על ידי החברה.

המוצרים המשווקים באתר הם מוצרים בעיצוב יפני הנרכשים מספקים ויצרנים שונים ביפן. מקום הייצור בפועל עשוי להשתנות בהתאם למותג, לדגם ולפריט הספציפי. מחירי המוצרים נקבעים באופן עצמאי על ידי החברה ועשויים להיות שונים ממחירי היצרן, היבואן או המשווק במדינות אחרות, בין היתר בשל עלויות רכש, שילוח, יבוא, מיסוי, מכס, אחסון ועלויות תפעול שונות.

1. אספקה ומשלוחים

אספקת המוצרים מתבצעת באמצעות חברת שליחויות לכתובת שתימסר על ידי הלקוח, בתיאום מראש. זמן האספקה הרגיל הוא עד 5 ימי עסקים ממועד אישור ההזמנה, למעט פריטים המיובאים מיפן לפי דרישה. החברה אינה אחראית לעיכובים הנובעים מחברות השילוח, תנאי מזג האוויר, שביתות, או כל גורם שאינו בשליטתה.

1. טעויות ואי-דיוקים באתר

החברה עושה מאמצים סבירים להבטיח כי המידע המופיע באתר יהיה מדויק, מלא ועדכני. יחד עם זאת, ייתכן כי יופיעו באתר, בתום לב, טעויות סופר, טעויות טכניות, אי-דיוקים, השמטות או טעויות בתיאור המוצרים, במחיריהם, בזמינותם, בתמונותיהם או בכל פרט אחר.

החברה שומרת לעצמה את הזכות לתקן כל טעות, אי-דיוק או השמטה כאמור בכל עת וללא הודעה מוקדמת.

במקרה שבו נפלה טעות מהותית בפרטי המוצר, במחירו, בזמינותו או בכל פרט מהותי אחר הנוגע להזמנה, תהא החברה רשאית לבטל את ההזמנה, כולה או חלקה, לפי שיקול דעתה, ולהשיב ללקוח את מלוא הסכום ששולם בפועל בגין ההזמנה שבוטלה.

1. אחריות החברה והגבלתה

המוצרים המשווקים באתר מיובאים על ידי החברה מספקים ויצרנים שונים ביפן ונמכרים בישראל על ידי טוקיו סטיילינג בע"מ. כל פנייה, בקשת שירות או מימוש אחריות בקשר למוצרים שנרכשו באמצעות האתר תטופל על ידי החברה בלבד.

בכפוף להוראות כל דין, החברה לא תישא באחריות לנזק עקיף, תוצאתי או לאובדן רווחים הנובעים מהשימוש באתר או מהמוצרים הנמכרים באמצעותו. בכל מקרה, אחריות החברה, ככל שתחול, לא תעלה על הסכום ששולם בפועל בגין המוצר או ההזמנה נשוא הטענה.

החברה לא תהיה אחראית לעיכוב או לאי-ביצוע התחייבויותיה עקב נסיבות שאינן בשליטתה הסבירה, לרבות כוח עליון, תקלות תקשורת, שביתות, עיכובי שילוח או מכס וכל אירוע בלתי צפוי אחר.

1. מבצעים והנחות

החברה רשאית להציע מבצעים, הנחות והטבות מעת לעת, ורשאית לסיימם בכל עת ללא הודעה מוקדמת. לא ניתן לצבור הנחות ומבצעים שונים באותה עסקה, אלא אם צוין במפורש אחרת.

1. קניין רוחני

כל התמונות, הטקסטים, העיצובים, הלוגואים והמותגים המוצגים באתר הינם רכוש בעליהם המשפטיים ומוגנים בזכויות יוצרים וסימנים מסחריים. אין להעתיק, לשכפל, להפיץ, לשדר, או לעשות כל שימוש מסחרי בתוכן זה ללא אישור מפורש בכתב מראש. המותגים, השמות המסחריים וסימני המסחר של היצרנים והספקים השונים המופיעים באתר הינם רכושם הבלעדי של בעליהם החוקיים ומוצגים באתר לצורכי זיהוי ותיאור המוצרים בלבד.

1. פרטיות

המידע האישי שיימסר בעת הרכישה ישמש לצורך עיבוד ההזמנה ושירות לקוחות בלבד. השימוש במידע כפוף למדיניות הפרטיות של האתר, המהווה חלק בלתי נפרד מתקנון זה.

1. דין וסמכות שיפוט

תקנון זה כפוף לדיני מדינת ישראל. סמכות השיפוט הבלעדית לכל מחלוקת הנוגעת לאתר זה נתונה לבתי המשפט המוסמכים במחוז תל אביב–יפו.

Welcome to the Block 26 website, operated by Tokyo Styling Ltd (טוקיו סטיילינג בע"מ), Company No. 516260817, Shabazi Street 59, Neve Tzedek, Tel Aviv 6514432 (hereinafter: "the Company"). These Terms of Service govern the relationship between the Company and any user or purchaser on the site and constitute a binding legal agreement. Browsing the site, placing an order, or making a purchase constitutes full acceptance of these Terms. Where masculine language is used, it refers equally to all genders.

1. General Terms of Use

Use of this site and making purchases through it is intended for persons aged 18 and over, holding a valid payment method and with a delivery address within the State of Israel. Minors may use the site only with the consent of their parent or legal guardian. By making a purchase, the user declares that they meet these conditions.

The Company reserves the right to amend these Terms from time to time, at its sole discretion. Continued use of the site following any amendment constitutes acceptance of the updated Terms. In the event of a conflict between these Terms and other content on the site, these Terms shall prevail.

1. Company Independence — Important Legal Clarification

Tokyo Styling Ltd is an independent Israeli company registered under Israeli law, operating as an independent importer that purchases products from suppliers in Japan and distributes them in Israel under the Block 26 brand.

Clarification: There is no legal, corporate, agency, or ownership relationship between Tokyo Styling Ltd and the manufacturers of the brands M'S Collection, SCOMMAG, BLESS, Petit Collection, and Hawaiian Jewelry, their parent companies, subsidiaries, or affiliated entities abroad. The Company is not an official agent, authorized representative, or subsidiary of these brands. All inquiries, demands, complaints, service requests, claims, or legal actions of any kind in connection with products purchased through this site shall be directed to the Company only. The user shall have no claim, demand, or legal action against the manufacturers, brand owners, their parent companies, subsidiaries, or anyone acting on their behalf, in connection with products purchased through this site.

1. Orders, Import from Japan and Stock Availability

Upon completing a purchase, payment is charged automatically and an order confirmation is sent to the email address provided. Receipt of an order confirmation indicates only that the order has been received by the Company's systems and does not constitute a final confirmation of the transaction or a commitment to supply the product.

Block 26 products are imported from Japan and sold in Israel by Tokyo Styling Ltd. Product availability is subject to existing stock levels. Items not immediately available in stock are imported specifically for the customer in accordance with their order, and estimated delivery time may range from 4 to 8 weeks from the date of order confirmation. By completing payment, the customer expressly acknowledges and accepts these delivery timeframes and the fact that products are imported from Japan.

The Company reserves the right to cancel an order for any reason — including product unavailability, discontinuation, pricing errors, customs delays, or any other reason that prevents supply of the product under reasonable conditions. In the event of cancellation by the Company, the customer will receive a full refund of the amount actually paid for the cancelled order, and shall not be entitled to any compensation, indirect damages, loss of profit, or further remedy, except as required by law.

Product images displayed on the site are for illustrative purposes only. Minor differences may exist between the image and the product actually supplied, including in colour and other characteristics.

1. Prices and Payment

All prices displayed on the site are in New Israeli Shekel (₪) and include VAT as required by law, unless explicitly stated otherwise.

The Company may, at its sole discretion and at any time, update, change, or remove prices, promotions, discounts, benefits, products, collections, stock levels, and terms of sale, in whole or in part, without prior notice. Such changes shall take effect from the date of their publication on the site only, and shall not apply to orders that were confirmed and completed prior to such changes.

The binding price is the price displayed on the site at the time of completing and confirming the order by the Company.

Products sold on the site are of Japanese design and are purchased from various suppliers and manufacturers in Japan. Country of manufacture may vary depending on the brand, model, and specific item. Prices are set independently by the Company and may differ from manufacturer, importer, or distributor prices in other countries, due in part to purchase costs, shipping, import, taxation, customs, storage, and various operating expenses.

1. Delivery and Shipping

Products are delivered via courier to the address provided by the customer, by prior arrangement. Standard delivery time is up to 5 business days from order confirmation, except for items imported from Japan on demand. The Company is not responsible for delays caused by shipping companies, weather conditions, strikes, or any factor beyond its control.

1. Errors and Inaccuracies on the Site

The Company makes reasonable efforts to ensure that information appearing on the site is accurate, complete, and up to date. However, typographical errors, technical errors, inaccuracies, omissions, or mistakes in product descriptions, prices, availability, images, or any other detail may appear on the site in good faith.

The Company reserves the right to correct any such error, inaccuracy, or omission at any time and without prior notice.

In the event of a material error in product details, price, availability, or any other material detail relating to an order, the Company shall be entitled to cancel the order, in whole or in part, at its discretion, and to refund the customer the full amount actually paid for the cancelled order.

1. Company Liability and Limitation

Products sold on the site are imported by the Company from various suppliers and manufacturers in Japan and sold in Israel by Tokyo Styling Ltd. All inquiries, service requests, or warranty claims in connection with products purchased through the site will be handled by the Company only.

Subject to the provisions of applicable law, the Company shall not be liable for indirect, consequential damages, or loss of profit arising from the use of the site or from products sold through it. In any event, the Company's liability, to the extent it applies, shall not exceed the amount actually paid for the product or order in respect of which the claim is made.

The Company shall not be held responsible for delay or failure to perform its obligations due to circumstances beyond its reasonable control, including force majeure, communication failures, strikes, shipping or customs delays, and any other unforeseen event.

1. Promotions and Discounts

The Company may offer promotions, discounts, and benefits from time to time, and reserves the right to end them at any time without prior notice. Discounts and promotions may not be combined in the same transaction unless explicitly stated otherwise.

1. Intellectual Property

All images, texts, designs, logos, and brands displayed on the site are the property of their respective legal owners and are protected by copyright and trademark law. No copying, reproduction, distribution, transmission, or commercial use of this content is permitted without prior written consent. The brands, trade names, and trademarks of the various manufacturers and suppliers appearing on the site are the exclusive property of their respective legal owners and are displayed on the site solely for the purpose of identifying and describing the products.

1. Privacy

Personal information provided at the time of purchase will be used solely for order processing and customer service. Use of this information is subject to the site's Privacy Policy, which forms an integral part of these Terms.

1. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Israel. Exclusive jurisdiction over any dispute relating to this site is vested in the competent courts of the Tel Aviv–Jaffa district.
